DFW AUTO BODY PARTS TERMS OF SERVICE & CONDITIONS OF SALE Dallas-Fort Worth, Texas | Effective Date: May 18, 2025 | Last Revised: May 18, 2025
PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING, USING, OR INSTALLING ANY PARTS.
1. ACCEPTANCE OF TERMS
By placing an order, making a purchase, visiting our location, accessing our website, or using any service provided by DFW Auto Body Parts (hereinafter "Company," "we," "us," or "our"), you (hereinafter "Customer," "Buyer," or "you") unconditionally agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately cease all use of our services and refrain from making any purchase.
These Terms constitute a legally binding contract between you and DFW Auto Body Parts. Your continued use of our services or completion of any purchase constitutes your acknowledgment and acceptance of these Terms in their entirety.
2. NATURE OF PARTS
ALL PARTS SOLD ARE BRAND NEW AFTERMARKET UNLESS EXPLICITLY STATED OTHERWISE IN WRITING.
Customer expressly acknowledges and agrees to all of the following:
- It is the sole responsibility of the Customer or their licensed mechanic to verify part fitment, compatibility, and condition prior to installation.
- DFW Auto Body Parts makes no representation that any part will be compatible with Customer's specific vehicle, trim level, model year variant, or optional equipment package.
- Photographs, descriptions, or verbal representations are provided as general guidance only and do not constitute a warranty of any kind.
3. ALL SALES ARE FINAL — RETURN & REFUND POLICY
3.1 General Rule
ALL SALES ARE FINAL. No returns, exchanges, or refunds will be accepted except under the narrowly defined conditions set forth in Section 3.2 below.
3.2 Limited Return Eligibility
A return may be considered ONLY if ALL of the following conditions are simultaneously met:
- The request is made within same calendar day of the date of received.
- The item should be returned with in 15 days after receiving if eligible for returns.
- The part has NOT been installed, modified, cut, welded, painted, drilled, or altered in any way.
- The part is returned in the exact same condition as sold, with original tags and receipt.
- Customer provides written documentation from a licensed mechanic confirming the part was incorrect for the stated vehicle.
- The return is pre-authorized in writing by a DFW Auto Body Parts manager prior to the item being brought back.
3.3 Non-Returnable Items
The following items are NEVER eligible for return or refund under any circumstances:
- Electrical components (ECUs, sensors, modules, wiring harnesses, switches, relays, fuses).
- Any part that has been installed or shows evidence of attempted installation.
- Special-order parts or parts procured specifically upon Customer request.
- Fluids, filters, gaskets, and seals.
- Parts purchased at clearance or final-sale pricing.
3.4 Restocking Fee
All approved returns are subject to a minimum 10% restocking fee. Approved refunds will be issued as in-store credit only, at the sole discretion of Company management.
4. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DFW AUTO BODY PARTS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- THE IMPLIED WARRANTY OF MERCHANTABILITY.
- THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
- ANY WARRANTY THAT PARTS ARE FREE FROM DEFECT, LATENT OR PATENT.
- ANY WARRANTY OF TITLE, NON-INFRINGEMENT, OR QUIET ENJOYMENT.
No employee, agent, or representative of DFW Auto Body Parts is authorized to make any warranty on behalf of the Company, and any such unauthorized representation shall be void and unenforceable. Any written warranty, if provided, shall be narrowly construed and limited solely to its express terms.
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW AND APPLICABLE FEDERAL LAW, DFW AUTO BODY PARTS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind.
- Loss of profits, revenue, business, data, goodwill, or anticipated savings.
- Damages arising from the installation, use, misuse, or failure of any part sold.
- Personal injury or property damage arising from installation or use of any part, whether performed by Customer or a third-party mechanic.
- Vehicle damage, mechanical failure, or accident caused directly or indirectly by any part purchased from DFW Auto Body Parts.
- Any damages exceeding the original purchase price of the specific part at issue.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF DFW AUTO BODY PARTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. CUSTOMER RESPONSIBILITY & INSTALLATION
Customer assumes full and exclusive responsibility for:
- Verifying that any purchased part is correct for their specific vehicle (year, make, model, trim, engine, and VIN) before purchase.
- Ensuring that installation is performed by a qualified, licensed automotive technician.
- Compliance with all applicable federal, state, and local safety standards, emissions regulations, and vehicle codes in connection with the installation or use of any part.
- Obtaining any required inspections, certifications, or approvals from relevant authorities following installation.
- Any damage to the Customer's vehicle or third-party property resulting from improper installation.
DFW Auto Body Parts strongly recommends that all parts be inspected by a qualified mechanic before installation. Installation of any part constitutes Customer's final acceptance of the part as-is and waives any right to return.
7. SAFETY-CRITICAL COMPONENTS
IMPORTANT SAFETY NOTICE:
Certain parts — including but not limited to brakes, steering components, suspension components, airbags, seatbelts, tires, wheels, axles, and fuel system components — are safety-critical. Customer acknowledges:
- Safety-critical used parts are sold strictly for off-road, display, or non-operational vehicle use unless Customer provides written certification of professional inspection and mechanical approval.
- DFW Auto Body Parts is not liable for any injury, death, or property damage resulting from the installation or use of any safety-critical component.
- It is Customer's sole responsibility to have all safety-critical components professionally inspected and certified before installation on any road-operated vehicle.
8. PRICING, PAYMENT & TITLE
- All prices are subject to change without notice. The price at the time of completed payment transaction is the binding price.
- Title and risk of loss pass to Customer at the moment of payment completion and physical transfer of the part.
- DFW Auto Body Parts accepts cash, major credit/debit cards, and approved electronic payments.
- Sales tax will be collected in accordance with Texas Tax Code, Chapter 151.
- All prices are in U.S. Dollars.
9. INDEMNIFICATION
Customer agrees to fully defend, indemnify, and hold harmless DFW Auto Body Parts and its owners, officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, costs, liabilities, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Customer's purchase, installation, use, or misuse of any part.
- Customer's breach of these Terms.
- Any third-party claims arising from Customer's use of any purchased part.
- Any violation of applicable law or regulation by Customer.
- Any personal injury or property damage caused by a part after it leaves DFW Auto Body Parts' possession.
10. GOVERNING LAW & DISPUTE RESOLUTION
10.1 Governing Law These Terms and any dispute arising hereunder shall be governed exclusively by the laws of the State of Texas, without regard to its conflict-of-laws provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
10.2 Venue & Jurisdiction Any legal action arising from or related to these Terms shall be brought exclusively in the state or federal courts located in Tarrant County or Dallas County, Texas. Customer irrevocably consents to personal jurisdiction and venue in such courts.
10.3 Mandatory Arbitration Any dispute, claim, or controversy arising out of or relating to these Terms or any transaction with DFW Auto Body Parts that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Dallas, Texas. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
10.4 Class Action Waiver CUSTOMER WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST DFW AUTO BODY PARTS. All claims must be brought on an individual basis only.
10.5 Time Limitation on Claims Any claim or cause of action against DFW Auto Body Parts must be filed within one (1) year of the date the claim arose, regardless of any statute of limitations to the contrary, to the extent permitted by Texas law. Claims not filed within this period are permanently barred.
11. ENVIRONMENTAL COMPLIANCE
Customer is solely responsible for ensuring that any part containing fluids, refrigerants, batteries, or hazardous materials is handled, transported, installed, and disposed of in compliance with all applicable federal EPA regulations, Texas Commission on Environmental Quality (TCEQ) rules, and local ordinances. DFW Auto Body Parts is not liable for any fines, penalties, or cleanup costs resulting from Customer's failure to comply.
12. INTELLECTUAL PROPERTY
All content on DFW Auto Body Parts' website, signage, and marketing materials — including logos, trademarks, text, images, and product descriptions — is the exclusive property of DFW Auto Body Parts or its licensors and is protected under U.S. and Texas intellectual property law. Unauthorized reproduction, distribution, or use is strictly prohibited.
13. PRIVACY & DATA
DFW Auto Body Parts collects Customer contact and transaction information solely for business purposes, including processing transactions, complying with legal obligations, and communicating with Customers regarding their orders. We do not sell Customer data to third parties. By transacting with us, you consent to this use of your information.
14. FORCE MAJEURE
DFW Auto Body Parts shall not be liable for any delay, failure to perform, or interruption of service resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, governmental action, labor disputes, supply chain disruptions, or civil unrest.
15. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT & MODIFICATIONS
These Terms, together with any written invoice or receipt issued at the time of sale, constitute the entire agreement between Customer and DFW Auto Body Parts with respect to the subject matter herein and supersede all prior agreements, representations, and understandings. DFW Auto Body Parts reserves the right to modify these Terms at any time. Continued use of our services after any modification constitutes acceptance of the updated Terms.
17. NO WAIVER
Failure by DFW Auto Body Parts to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any specific breach shall not constitute a waiver of any subsequent breach of the same or any other provision.
18. ATTORNEYS' FEES
In any legal action, arbitration, or proceeding arising from these Terms or any transaction with DFW Auto Body Parts in which DFW Auto Body Parts prevails, Customer agrees to pay all of Company's reasonable attorneys' fees, court costs, and legal expenses, to the extent permitted by Texas law.

CUSTOMER ACKNOWLEDGMENT
By completing any purchase with DFW Auto Body Parts, whether in-person, by phone, or online, Customer acknowledges that they have READ, UNDERSTOOD, and AGREED to all provisions of these Terms of Service. Customer further acknowledges that they have had the opportunity to seek independent legal counsel prior to agreeing to these Terms.
